Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of Cresa, operated by Crest Sync (Private) Limited (“Cresa,” “we,” “us”). By creating an account or using the service, you agree to these Terms. If you use the service on behalf of an organization, you represent that you are authorized to bind that organization.

2. The Service

Cresa provides business-messaging software that helps authorized customers manage inboxes, automate workflows, and send AI-assisted and template-based responses across supported channels, including WhatsApp, Facebook Messenger, Instagram, website chat, and email.

3. Accounts & Eligibility

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be legally able to enter into these Terms and use the service only for lawful business purposes.

4. Authorized Use & Platform Compliance

You may connect and use only channels, pages, and accounts you own or are explicitly authorized to manage. You are responsible for complying with the rules of the platforms you connect, including the Meta Platform Terms, the WhatsApp Business Messaging Policy, and Instagram and Messenger platform policies — including requirements for recipient opt-in, permitted message categories, and the 24-hour customer-service window.

5. Customer Responsibilities

You are responsible for the content you send, obtaining any required consent from message recipients, the accuracy of the business information you provide, and reviewing AI-generated responses before enabling automated reply behavior in production. AI output may be inaccurate or incomplete and is provided as an aid, not as professional advice.

6. Fees & Billing

Paid plans are billed through our payment processor (Paddle) on a recurring basis unless cancelled. Fees are non-refundable except where required by law or expressly stated. Third-party messaging charges (for example, WhatsApp conversation fees billed by Meta) are separate and are your responsibility. We may change pricing on prospective notice.

7. Acceptable Use

You agree not to use the service to:

  • send spam, unsolicited, deceptive, or unlawful messages;
  • violate any third-party platform policy or applicable law;
  • infringe intellectual property or privacy rights;
  • transmit malware or attempt to disrupt or gain unauthorized access to the service;
  • reverse engineer or resell the service except as permitted.

8. Intellectual Property

Cresa and its software, trademarks, and content are owned by Crest Sync (Private) Limited and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You retain ownership of your own content and data.

9. Third-Party Services

The service integrates with third-party platforms and providers (including Meta, OpenAI, Google, ElevenLabs, and Paddle). Your use of those platforms is subject to their terms, and we are not responsible for their acts, omissions, or availability.

10. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that AI output will be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, Cresa and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability arising out of or related to the service will not exceed the amounts you paid to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Cresa from claims, damages, and expenses arising out of your content, your use of the service, or your violation of these Terms or any third-party platform policy or law.

13. Suspension & Termination

We may suspend or terminate access for misuse, security risk, non-payment, or violation of applicable law or platform policy. You may stop using the service at any time by disconnecting channels and requesting account closure. Provisions that by their nature should survive termination will survive.

14. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws principles. The courts of Pakistan will have exclusive jurisdiction over any dispute, subject to any mandatory rights you have under local law.

15. Changes to These Terms

We may update these Terms from time to time. We will revise the “Last updated” date and, where appropriate, provide additional notice. Continued use of the service after changes take effect constitutes acceptance.
